Rental Agreement - Terms & Conditions

Explore Madeira in comfort, style, and total peace of mind.

 

1.  General Principles

At CAEA Rent, we provide a premium car rental experience in Madeira, blending transparency, flexibility, and sophistication.

Our mission is to allow clients to explore the island with comfort, style, and complete peace of mind.

By renting from CAEA Rent, you acknowledge and agree to these Terms & Conditions and commit to full compliance throughout your rental experience.

 

2.  Vehicle Use & Driver Eligibility

  • Vehicles may only be driven by the client and authorised drivers listed in the contract. Unauthorised drivers invalidate insurance coverage.
  • Drivers must be 23+ years old with a valid driving licence held for at least 3 years.
  • Vehicles must remain on Madeira and comply with all local traffic laws.
  • Strictly prohibited:
  • Smoking inside the vehicle (€200 cleaning fee applies).
    • Driving under the influence of alcohol, drugs, or intoxicants.
    • Racing, towing, sub-renting, or transporting passengers/merchandise for payment.
    • Transporting the vehicle to Porto Santo or outside Madeira.
    • Overloading passengers or cargo beyond vehicle limits.
  • Vehicles must be locked and secured when not in use. Documents should never be left inside.
  • Unauthorised transfer, sale, pledge, or mortgage of the vehicle, contract, or accessories is strictly prohibited. CAEA Rent may immediately repossess the vehicle and claim damages.

 

 

3.  Booking & Payment

  • Reservations via website or directly with our team.
  • Payment options:
    • Deposit: 10% at booking, balance at vehicle delivery.
    • Full payment: At the time of booking.
  • Full payment is required to confirm the reservation. Failure may trigger legal action.
  • Rental fees, extensions, and additional charges are based on current tariffs at booking.

 

 

4.  Vehicle Delivery & Collection

  • Delivery/collection at airports, hotels, or select remote locations.
  • CAEA Rent provides 24/7 roadside assistance throughout the rental.
  • Meeting points and instructions are confirmed at booking.
  • Vehicles must be returned on time at the agreed location; late returns may incur additional fees.

 

 

5.  Security Deposit & Fuel Policy

  • Deposit: Credit/debit card may be required.
  • Fuel: Vehicle delivered full; must be returned full.
  • Fuel deposit: €100, refunded if tank is full.
  • Incorrect fuel or incomplete tank: deposit forfeited + additional fees.

Client is responsible for oil, radiator, and gearbox fluids; reimbursement requires valid receipts.

 

 

6.  Insurance & Damage Policy

  • Basic Insurance: Third-party liability coverage.
  • Comprehensive Insurance: Full vehicle coverage.
  • Only authorised drivers are covered.

Client responsibilities in case of an incident:

  • Notify CAEA Rent within 24 hours of accident, theft, fire, or damage.
  • Report to local authorities and provide a detailed report: date, location, circumstances, witnesses, and other vehicles.
  • Do not admit liability without CAEA Rent authorisation.

Insurance exclusions:

  • Unauthorised drivers or driving without a valid licence.
  • Driving under the influence of alcohol/drugs.
  • Off-road or improper use.
  • Negligence (tyres, windows, interior, lost documents) not covered.

Options at contract signing:

  • Deposit Insurance: Security deposit to cover potential damage.
  • Full Comprehensive Insurance: No deposit, higher daily rate.

 

 

7.  Maintenance & Repairs

Normal mechanical maintenance is the responsibility of CAEA Rent.

  • Repairs require prior written consent and must follow instructions.
  • No compensation/refund for delays due to maintenance or repairs.
  • CAEA Rent is not liable for manufacturing defects or previous repairs.

 

 

8.  Additional Services

  • Child seats available upon request (additional charge).
  • Additional drivers, airport delivery, or remote locations may incur supplementary fees.

 

 

9.  Client Responsibility & Liability

  • Clients and authorised drivers must use vehicles responsibly.
  • Assistance requiring staff dispatch incurs a minimum fee of €50, except for genuine mechanical failure.
  • Accidents caused by the client void replacement/refund/compensation.
  • Clients are responsible for all fines, penalties, and legal expenses from misuse or negligence.

 

 

10.   Cancellation Policy

  • Flexible: Free cancellation up to 48 hours before pick-up.
  • Moderate: 50% refund up to 48 hours.
  • Strict: No refund within 48 hours.
  • Cancellations less than 24 hours before pick-up may incur partial retention (10% deposit or full payment).

Refunds via original payment method; administrative fees may apply.

 

 

11.  Contract Validity & Amendments

  • Only written, signed modifications by both parties are valid.
  • Verbal modifications are null and void.
  • CAEA Rent may update or amend terms communicated at booking.

 

 

12.   Applicable Law & Jurisdiction

  • Governed by Madeira, Portugal law.
  • Disputes submitted to the Court of Funchal, exclusive jurisdiction.

 

 

13.   Privacy & Data Protection

  • Personal data (driving licence, contact info) collected solely for rental purposes.
  • Data handled according to CAEA Rent Privacy Policy and GDPR.
